So I have an expired F1 visa and I have approved I797 for H1b. I don’t have the H1b stamping. I’m currently in the US. I need to land in canada before July 2nd for my PR. My I-94 is valid for another 3 years. Since this Executive Order isn’t impacting F1 visa, can I use the Automatic Visa Revalidation to enter US from Canada on expired F1 visa?

As a Canadian PR you may be able to enter it and rely of F-1. You may be able to change status to H-1B later.

The H1B et al programs are to white collar, technical employees as illegal immigration is to blue collar workers, and it all needs to stop.
The only point to it is to drive down wages on jobs that large corporations haven’t [yet] off-shored.
ReplyNo work visa for people from CHAZ and suspend all foreign aid to CHAZ. This includes all American government transfer payments. An exception could be made during the harvest of crops, but they have to wear electronic tracking device.
ReplyThis would be interesting to see. All the big name contractors in DC would have to RE-HIRE all the American high tech folks they laid off to keep the Indians!! I wish he would do it.

Thank you for contacting our firm with your question. According to our managing partner, Jon Velie, the H-1B, H-2B, and L-1 visas are suspended if the holder is out of the country, unless their visa is already stamped. There are also a few other exceptions depending on the situation.

ReplyHi. What about F1 student visa’s? I am a british citizen and also a student at a US university. I have been in the UK since April and I haven’t heard anything on if F1 visa students will be/are allowed back into the US

Unfortunately, our firm does not process student visa. Those are handled exclusively by most universities. I would suggest calling the international student services for whichever school you plan to or currently attend.
