One issue that small and/or new companies often overlook when applying for the H-1B visa, is that USCIS will look at the size, age, number of employees and revenue generated when they are deciding whether to issue the visa. USCIS has a fraud detection unit that looks for:
- What year the company was established;
- Number of employees;
- Revenue generated.
If two of the three criteria are either low or indicate that the company is new, immigration officials will send it to the fraud detection unit and a Request for Evidence (RFE) will be issued.
