How Will Biden’s Business Immigration Policy Differ from Trump’s?

We compare the business immigration policies that President-elect, Joe Biden, has proposed to those that President Trump has enforced.

It is not a surprise to anyone that President Trump has been the most anti-immigration president in modern history.

How will Joe Biden’s immigration policy differ? Will he throw out all of Trump’s policies and open the borders to anyone and everyone?

Under President Biden we would likely see a return to the immigration policies that were in place in the Obama Administration, since Vice-President Biden was part of Obama’s team.

But times have changed, the world has changed, we are in a pandemic and in an economic recession as a result.

First, Joe Biden has already declared in a Town Hall meeting that he will immediately lift Trump’s temporary suspension of H-1B visas. There are currently three lawsuits pending that seek to overturn limits on the merit-based H-1B visa.

Further great news for those wishing to use the U.S. immigration process is that Trump’s senior adviser and anti-immigration architect, Stephen Miller, will no longer be working for the Government.

Mr. Miller had stated to NBC prior to the election that he would introduce even more limits to work-based visas.

One tactic that Trump used in his immigration policy was to change the mission of USCIS from “a nation of immigrants” to “America first”. That mindset led to more visa petition denials than we had ever seen before. One visa, the H-1B, saw approvals plummet from 88% under Obama to just 59% under Trump, with an attack on companies using highly-educated Indian foreign nationals.

If USCIS remove the H-1B cap or the long wait lines for Indians to receive green cards, we could see a jump in tech workers and students coming to America. This has historically been shown to grow U.S. companies, increase jobs for Americans, and one report indicated that we would see a growth in the U.S. economy of $100BN over 10 years if we removed the restrictions on work immigration.
